Terms & Conditions

DRAFT — requires legal review (in particular §3, §7 and §9).

§1 General provisions

1. The Cartomat.pl online store (the "Store") is operated by [FULL COMPANY NAME, ADDRESS, TAX ID, COMPANY REGISTRATION — to be completed] (the "Seller").

2. The Seller can be contacted via the contact form available in the Store.

3. These Terms set out the rules for placing orders for products printed to the customer's individual specification (wedding and occasion stationery), and the rules for fulfilling those orders.

§2 Orders and file specification

1. Orders are placed through the product configurators available in the Store. The Customer selects the format, paper and quantity, and uploads the print file.

2. The print file must meet the technical specification: PDF format, 3 mm bleed, minimum 300 DPI resolution, CMYK colour space. Files that do not meet the specification may be rejected at upload or — in the case of minor deviations (for example RGB instead of CMYK) — converted automatically.

3. The minimum order quantity is 50 pieces per product, unless the product description states otherwise.

§3 Declaration of rights to the submitted artwork

1. By placing an order, the Customer declares that they hold the copyright or an appropriate licence to the submitted file (the design) and all of its elements, and that using the file for printing does not infringe the rights of third parties.

2. The Seller does not verify the origin of submitted files and is not liable for infringements of third-party rights arising from content supplied by the Customer.

3. Should third parties bring claims against the Seller in connection with a file supplied by the Customer, the Customer undertakes to release the Seller from liability to the extent permitted by law.

§4 Responsibility for file accuracy

1. The Customer is responsible for the content, spelling and layout of the submitted file matching their intent. The Seller does not proofread text or artwork.

2. The Seller is responsible for the print matching the submitted file within the limits of the technical specification (colour within printing tolerance, bleed, resolution).

3. Under the current self-service model, the Seller does not send an automatic proof before printing.

§5 Prices and payment

1. Prices shown in the Store are gross prices (they include VAT).

2. The order price is known to the Customer before the order is placed. Payment is made in advance, using the payment methods available in the Store.

§6 Turnaround times

1. Orders that are paid for and submitted with a valid file before 11:00 on a working day are passed for dispatch the same working day. Orders placed later are dispatched the next working day.

2. The time limit in paragraph 1 runs from acceptance of a valid file. Rejection of a file that does not meet the specification suspends the time limit until a valid file is supplied.

3. [TO BE COMPLETED: consequences of the Seller missing an express deadline — e.g. discount or refund of shipping costs.]

§7 Complaints

1. Complaints may be submitted through the contact form within [TO BE COMPLETED] days of receiving the parcel, with photographs of the defect attached.

2. A complaint is justified where the print does not match the submitted file through the Seller's fault (machine error, damage in production, format or paper not matching the order). In such cases the Seller will reproduce the order or refund the price.

3. Complaints do not cover defects arising from the Customer's file (errors in content, low resolution accepted by the Customer despite a warning, colour shifts resulting from RGB→CMYK conversion, missing bleed).

4. The Seller considers complaints within 14 days.

§8 Delivery

1. Orders are delivered by the carriers listed in the Store to the address given by the Customer.

2. The delivery cost is shown when the order is placed.

§9 Right of withdrawal

1. Products offered in the Store are made to the Customer's specification and serve their individualised needs (printing from a file supplied by the Customer, personalisation).

2. Under art. 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply to contracts where the subject of performance is a non-prefabricated item, produced to the consumer's specification or serving their individualised needs.

3. The above does not exclude the Customer's rights under statutory warranty / non-conformity of goods with the contract (§7).

§10 Personal data

The rules for processing personal data are set out in the Privacy Policy.

§11 Final provisions

1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

2. The Seller may amend these Terms; orders placed before an amendment are governed by the Terms in force at the time the order was placed.
